Delhi Court Issues Fresh Summons to YouTuber Dhruv Rathee in 2018 Defamation Case

New Delhi, Oct 2026 : A Delhi court has issued fresh summons to YouTuber Dhruv Rathee in a 2018 defamation case filed by Vikas Pandey, a member of the Bharatiya Janata Party's (BJP) IT cell. The court noted that Rathee had reportedly been residing in Austria for the past seven years and had recently returned to India amid protests in the national capital.

Judicial Magistrate Rahul Jain was hearing an application filed by Pandey seeking the issuance of fresh summons against Rathee. In an order dated October 12, the court observed that the complainant had been attempting to serve summons on the accused for several years.

“The available record makes it clear that the complainant has been trying to get the summons served upon accused No. 1 (Rathee) for the past several years,” the court noted.

Advocate Samaksh Sharma, appearing for the complainant, informed the court that Rathee ordinarily resides in Austria and had come to India in connection with protests organised in Delhi by the Cockroach Janata Party (CJP). He argued that fresh summons were necessary to enable immediate steps for their service.

The court also noted that summons had previously been issued to Rathee in July 2019. It subsequently directed that fresh summons be issued at his address in Gurugram, Haryana.

The case dates back to 2018, when Pandey filed a defamation complaint against Rathee following the publication of a video about him on the YouTuber's channel.

The latest order relates to the procedural steps being taken to serve the summons and move the complaint forward. The issuance of summons does not establish guilt, and the allegations in the defamation case remain subject to judicial proceedings.

Further developments will depend on the service of the fresh summons and the subsequent proceedings before the court.
